PTS TERMS & CONDITIONS 

 

By making your reservation with Pirata Transportation Services Inc. (PTS) you agree to be bound by the following terms and conditions:

GENERAL

These Terms and Conditions are part of every agreement between Users with the arrangement and execution of a travel services offered by PTS.

 

Deviations from these Terms, even in the case of letters of confirmation and unreserved services, are hereby rejected. Only if the management of PTS has expressly agreed in writing, it does not apply.

User Registration Requirements for the Use of PTS Services

 

It is the User’s responsibility to ensure that all information that they, or someone else on their behalf, have provided to PTS is complete and accurate.

BEHAVIOR IN THE VEHICLE

 

The following behavioral standards apply to the User when traveling with the PTS. During the entirety of the ride, all guests must follow the regulations which apply: 

Seatbelts must always be used by all passengers at all times and car seats for children 5 and under. Any instructions given by the PTS Chauffer must be followed. It is the responsibility of the Chauffeur to ensure a safe ride. It is therefore prohibited for guests to open the doors while driving, throw any objects from the vehicle, and/or stick body parts out of or shout from the vehicle. If the User wishes to use any of the devices or facilities in the vehicle, a brief instruction is required from the Chauffeur. Smoking is prohibited inside of the vehicle. If the Client, or clients guest, ignores this, they are liable to pay not only the cost for the cleaning of the vehicle but also compensate the loss of business due to the downtime of the vehicle. The consumption of food is discouraged. Alcoholic drinks are not allowed to be consumed in the car under no circumstances.

CAR SEATS

 

PTS assumes no responsibility for any injury, or damages suffer by the user. Any car seat provided by PTS must be installed by the Parents or guardians using our services. Chauffeurs are neither authorized nor certified to install any type of car seat provided by PTS. 

CONFIRMATIONS

 

Credit card information will be required when you make your reservation. Upon receipt of your reservation request, subject to availability, we will email your confirmation. Reservations are not valid, unless you received a confirmation email from PTS. Only our office staff has the right to make and confirm reservations. Our chauffeurs are not allowed to make reservations, verbal confirmations will be void. We recommend that you make your reservation at least 48 hours prior to the actual pick-up time.  However, last minute reservations are possible depending on vehicle availability. Please check your confirmation carefully. If you find any errors in the confirmation email, please contact us immediately. Our drivers will be routed by the information on the confirmation email, such as pick up address and pick up times.

 

RATES

 

Rates are subject to availability and may change without notice prior to making the reservation. Rates will not change once the reservation has been approved and confirmed via email. All hourly rides will be charged at 50/15min or 200/hour if client goes over initial reserved hourly time. The client will be informed by Dispatch before reservation is accepted.  Garage time/mileage will be applied to all long distance rides.

 

WAITING TIME

 

Your vehicle is dispatched according to the reservation you scheduled online or with dispatch via email or by phone. There is a 30-minute time allowance on all flights from the time of your scheduled reservation. Billing shall revert to the prevailing hourly rate in the event the flight is delayed, client is delayed at baggage claim, or the waiting time is exceeded, beyond the allotted thirty (30) minutes for all flights. There is a 30-minute time allowance from the scheduled Seaport pickups and 15 minutes from local address pickups. After time allowance, there will be a $40 charge per 15 minutes added to the ride. After 1 hour of waiting time, the ride will be billed as a hourly charter that will be charged at the rate of 50/15min or 200/hour from original scheduled time. If you can not locate your driver, please call at (813)701-8030 to avoid being billed as a No Show. Additional Stops that are not requested in your reservation are billed at $40 per stop. Additional Requested Stops exceeding 15 minutes are billed at $50/15min.

PAYMENT INFORMATION

 

We will authorize your card as soon as the reservation is made. The card must have sufficient available funds, or your reservation will be cancelled. Your card information will be kept on file for any additional charges accrued after completion of your ride. We use a secure credit card gateway to process all credit card payments. All additional charges will be made aware to you via emailed invoice. 

EXCESS CLEANING FEE | VEHICLE DAMAGE

If, during or after the transportation service, the company is required to expend an extended amount of time and material to clean the vehicle due to acts of the client or any passenger (i.e., spilling food & drinks, vomiting, excessive trash), the company, at its discretion, will charge client additional fees to cover such expense.  Damage to the vehicle in any way caused by actions of the client or any passenger will be charged in full to repair and vehicle down time for the repair to the client.  The minimum clean up fee is $250. There is a mandatory $500.00 Bodily Fluid Clean Up Fee.

 

PROPERTY TRANSPORTED 

 

PTS DOES NOT assume responsibility for the handling or maintenance of any baggage or other property, nor for any property left in the company’s vehicles.  We will do everything possible to secure and retrieve any belongings left in the vehicle.  Please always check thoroughly prior to leaving the vehicle for all your personal belongings. Each guest is permitted to carry a reasonable amount of personal luggage aboard. However, there is a limit on space available on board. PTS is not responsible for additional luggage that won't fit due to space restrictions. "Our Duty"- PTS's Chauffeurs will do the absolute very best to accommodate all of the clients personal luggage on board.

 

ALCOHOL | SMOKING 

 

Absolutely NO alcohol may be consumed in any vehicles, NO exceptions. We will terminate the ride if anyone is caught consuming alcohol or smoking without a refund. PTS has the right to cancel the service and call local law enforcement if passengers are found carrying or using illegal substances. Smoking is prohibited, No exceptions.

 

HOURLY RIDES

 

Rides between locations to which a flat-rate does not apply will be billed for the time the vehicle and chauffeur are at your service. The vehicle hourly rate will apply. Hourly rides are billed per hour at the chosen vehicle prevailing hourly rate. Final charges are based on actual ride duration, plus garage-to-garage time. Garage time (positioning) is the cost incurred for the vehicle and chauffeur to travel to your pickup location and to return from your drop-off point. The minimum garage to garage time is 30 minutes. Hourly rates do not include tolls, parking, taxes and other miscellaneous charges, which will be added if applicable, upon ride completion. Time-based charges are billed in 15-minute increments.

 

 

CANCELATIONS

 

PTS requires cancelations by PHONE at least 24 hours prior to scheduled local pickup or 48 hours by EMAIL prior to scheduled local pickup. Cancellation charges equal to the rate confirmed at time of reservation will apply.

 

Reservations scheduled for pickup outside of the Greater Tampa Bay area require a cancelation by PHONE 48 hours prior to scheduled pickup or by EMAIL 72 hours prior to scheduled pickup. Cancellation charges equal to the rate confirmed at time of reservation will apply.

 

*Any cancellation not made within the required time by PHONE or EMAIL will be charged the full rate confirmed at the time of reservation. Cancelations made outside of the requirement time will be charged half of the service cost as well as any addition fees associated with the reservation. 

 

If the chauffeur for any dispatched reservation cannot get in contact with the client after 3 attempts in 15 minutes the trip will be terminated and billed at full cost of service to client.

 

All modifications that are mutually agreed upon in writing or communicated and confirmed at the time of reservation will supersede the above. Under review of management special consideration may be made due to charges levied on non-canceled reservations.

PET POLICY

 

Pets and service animals are allowed in PTS vehicles. A service dog transport form must be filed out and submitted prior to scheduled reservation along with a rabies vaccination card with the name of the producing laboratory, the type of vaccine and the number of the vial. It must have been administered no more than 1 year of scheduled reservation. 

For everyone’s safety all Pets must be leashed and muzzled or placed in a carrying case. Pets and service animals and must not travel next to your chauffeur. The Pets and service animals must be clean and well behaved. Pets and service animals may not be seated and will have to be accommodated on the floor (large breeds) or on the passenger's lap for small breeds. No food or drinks are permitted to be given to animals while in the vehicle. 

PTS may refuse transport if the animal poses a threat to health or safety, behavior of the animal allows the chauffeur to conclude that it does not have the proper training. Ex: running freely, barking, snarling, biting or jumping on people, urinating or defecating in the vehicle, lack of filling out and submitting forms required by PTS prior to scheduled reservation or Any of the above pet policy requirements are not met.

PRIVACY POLICY

Protecting your private information is our priority. This Statement of Privacy applies to PTS and its chauffeur ride service. By signing and using PTS service you consent to the data practices described in this policy.

 

Collection of your Personal Information 

In order to better provide you with our products and services offered, PTS may collect personally identifiable information, such as your:

 

– First and Last Name 
– Billing Information
– Email Address 
– Phone Number
– Pick Up/Drop Off Location(s)

 

If you purchase PTS’s products and services, we collect billing and credit card information. This information is used to complete the purchase transaction.

We do not collect any personal information about you unless you voluntarily provide it to us. However, you may be required to provide certain personal information to us when you elect to use certain products or services. These may include: (a) registering for an account; (b) entering a sweepstakes or contest sponsored by us or one of our partners; (c) signing up for special offers from selected third parties; (d) sending us an email message; (c) submitting your credit card or other payment information when ordering and purchasing products and services. PTS will use your information for, but not limited to, communicating with you in relation to services and/or products you have requested from us. We also may gather additional personal or non-personal information in the future.

 

Use of your Personal Information 


PTS collects and uses your personal information to operate and deliver the services you have requested. PTS may also use your personally identifiable information to inform you of other products or services available from PTS and its affiliates.

 

Sharing Information with Third Parties 


PTS does not sell, rent or lease its clients lists to third parties. 
PTS may share data with trusted partners to help perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries.

All such third parties are prohibited from using your personal information except to provide these services to PTS, and they are required to maintain the confidentiality of your information.

 

PTS may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on PTS or the site; (b) protect and defend the rights or property of PTS; and/or (c) act under exigent circumstances to protect the personal safety of users of PTS, or the public.

ZERO TOLERANCE POLICY

PTS strictly adheres to the regulations as codified by the FMCSA & FDOT and has a zero-tolerance drug and alcohol policy for all chauffeurs under the authority of PTS to provide service. If you suspect a chauffeur is under the influence of drugs or alcohol, please ask to end the trip immediately, then call 911 or your local non-emergency assistance line. Please also report any violations of this policy to PTS (Dispatch@PTS-Rides.com

LIABILITY

 

PTS is ONLY liable for damage caused by PTS and not their vicarious agents or subcontractors either intentionally or due to gross negligence. In case of damage caused by simple negligence, PTS is liable only for breach of fundamental contractual obligations and for foreseeable and typical damage. Fundamental contractual obligations are those which, when fulfilled, enable the proper execution of the contract and upon which the User can rely.

Limitation of liability does not apply in the context of an express guarantee of condition and quality, in case of intentional harm to life, body, or health, as well as claims under the Product Liability Act.

RELEASE OF LIABILITY BY THE USER

 

The User releases PTS of all claims and expenses, including appropriate attorneys fees, levied against PTS by a third party for any use of the PTS services by the User which violates the contract or is a breach of these Terms.

CHOICE OF LAW AND PLACE OF JURISDICTION

 

This Agreement and any associated purchases will be governed by and construed in accordance with the laws of the State of Florida (without regard to principles of conflicts of laws). The Parties agree that all actions or proceedings arising in connection with this Agreement will be tried and litigated exclusively in the appropriate court located in or for Pinellas County, Florida. This choice of venue is mandatory. Each Party waives any right it may have to assert the doctrine of forum non conveniens or similar doctrine or to object to venue with respect to any proceeding brought in accordance with this section. 

DEBT COLLECTION 

 

PTS is entitled to employ outside debt collection agency and/or institution and/or lawyers to collect any unpaid sum the Cardholder owes us or to enforce any of our rights against the Cardholder. The Cardholder consents to our disclosure of all such information and personal data relating to him to such debt collection agency and/or institution and/or lawyers as necessary for this purpose. Cardholder’s liability for our cost of enforcement.

SEVERABILITY 

 

If any section, subsection, sentence, clause, phrase, or portion of the Agreement is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion will be deemed separate, distinct, and independent provision, and such holding will not affect the validity of the remaining portion thereof. 

DISPUTES

 

In the event of a dispute arising out of this Agreement, including but not limited to Federal, or State statutory claims, the Parties' sole recourse (except as provided below) shall be to arbitration. Proceedings shall be conducted under the Commercial Arbitration Rules of the American Arbitration Association. Arbitration proceedings must be started within eighteen (18) months from the date of services rendered or scheduled date of reservation whichever is later, and shall take place in Pinellas County Florida. The decision of the arbitrators shall be binding and final and the award of the arbitrator may be entered as judgment in any court of competent jurisdiction. The prevailing party shall be entitled to recovery of costs, expenses and reasonable attorney fees as well as those incurred in any action for injunctive relief, or in the event further legal action is taken to enforce the award of arbitrators.

 

ADDITIONAL

 

In no event will PTS or affiliates be liable or responsible for damages of any kind caused by any delay in performance or failure to perform, in whole or in part, any of their obligations in connection with the services, where such delay or failure is due in part to fire, earthquake, weather, traffic, road construction, strikes, government sanctioned embargo, flood, act of God, act of war or terrorism, act of any public authority or sovereign government, civil disorder, delay caused by any air or ground passenger carrier, or any other circumstances beyond the reasonable control of PTS or affiliates. By signing you confirm that you have read our Terms & Conditions, which can be found on the PTS website (www.PTS-Rides.com) and agree that the terms of such policy are reasonable and satisfactory to you.
